1. The iPolitics Policies

Welcome to Green Chamber Guide, a website (ultimately) owned by iPolitics Inc. By accessing this site you agree to abide by all terms, conditions and notices contained or referenced in the iPolitics Terms of Use and Related Policies (the “iPolitics Policies”). Please read the iPolitics Policies carefully and in their entirety because they describe the terms of a legally binding agreement between you and iPolitics Inc.

This iPolitics Policies sets out the terms and conditions on which you may use the greenchamber.com / greenchamber.ca websites (the “Green Chamber Guide”) and other iPolitics services and the content/services available on them (collectively referred to as “iPolitics Content”). These terms apply to your use of Green Chamber Guide and all iPolitics Content irrespective of how you access it. If you use Green Chamber Guide or iPolitics.ca in the course of your business or work, you are also agreeing to these terms and conditions on behalf of that business.

If you do not agree with the terms and conditions contained in the iPolitics Policies (or are not authorised to do so on behalf of your business or work) you should not use Green Chamber Guide, iPolitics.ca or any iPolitics Content.

Except where stated otherwise, references in the iPolitics Policies to “iPolitics” (or “we”, “us” or “our”) refer to iPolitics Inc.

PLEASE NOTE THAT IN ADDITION TO OUR RIGHTS AT LAW TO ENFORCE THESE IPOLITICS POLICIES, THE RESTRICTIONS CONTAINED BELOW ARE ALSO CONTRACTUAL IN NATURE AND BIND ALL USERS OF IPOLITICS CONTENT.

2. Registering for Use

All information received by you from your use of Green Chamber Guide and iPolitics.ca will be used by iPolitics in accordance with our Privacy Policy below which you must read carefully to understand how we process your personal information.

It is your responsibility to provide iPolitics with accurate, complete registration information, and to update and maintain changes to that information on the applicable iPolitics.ca registration or subscription pages. iPolitics is entitled to rely on any information you provide to us. The commercial terms of registration are found on the Registration page. Each registration is for one single user only. On registration, you will choose a user name and password (“ID”). You are not allowed to share your ID or give access to iPolitics Content through your ID to anyone else. It is strictly prohibited to allow multiple users on a network or within an organization to use the same ID and iPolitics may cancel or suspend your access to iPolitics.ca if you share your ID. If you believe there has been any breach of security such as the disclosure, theft or unauthorised use of your ID you must notify iPolitics immediately by e-mailing us at customerservice@ipolitics.ca

3. Rules of Use

Please read Section 6 Copyright and Intellectual Property Policy below in conjunction with the following.

Organisations that may be using iPolitics Content without the appropriate permissions must purchase of additional registrations to legitimize that use. Please contact registration@ipolitics.ca for details.

Unless you are a registered user you may not be permitted to view any articles.

Permitted Use You may do the following in relation to iPolitics Content, (but these rights do not extend to content, data or other material published by iPolitics that belong to third parties which you may not republish or redistribute in whole or in part):

View iPolitics Content for your personal use on any device that is compatible with iPolitics.ca or any iPolitics application and store iPolitics Content on that device for your personal use;

Print single copies of articles on paper for your personal use;

Share links to articles by using the article tools we make available at the foot of each article;

Republish or redistribute “Summaries” of iPolitics articles. “Summaries” can be either an “extract” or an “abstract”. An “extract” is 30 words or less copied verbatim from an iPolitics article and inserted into another original work. An “abstract” is a 30 word non-verbatim summary of the news or facts reported in an iPolitics article which does not form part of a longer work. In order to republish or redistribute Summaries you must:

  • attribute the work as follows: “[journalist name] at iPolitics reported that”, with a hypertext link from the word “iPolitics” to the original article published on Green Chamber Guide or iPolitics.ca;
  • state, in the case of abstracts, “this abstract from Green Chamber Guide or iPolitics was produced by [name]”, with a hypertext link from the word “iPolitics” to the original story published on Green Chamber Guide or iPolitics.ca;
  • limit the number of Summaries to no more than ten summaries per day separately sourced from a different iPolitics article;
  • not use or allow the use of summaries in conjunction with the sale or dissemination of a product or service; and
  • immediately cease creating or using Summaries if iPolitics notifies you to do so, thereupon your rights to create Summaries shall cease.

Restrictions on Use You are strictly prohibited from using iPolitics.ca or iPolitics Content other than as “Permitted Use” described above including an absolute prohibition on doing any of the following:

  • copy, publish, republish or redistribute, communicate or disseminate to third parties any iPolitics Content unless you share articles using our ‘Email article’ tool;
  • copy, publish, republish or redistribute headlines in any way;
  • archive or store any of the iPolitics Content for access by anyone other than yourself;
  • create derivative works other than Summaries from the iPolitics Content;
  • remove the copyright or trade mark notice from any copies of iPolitics Content;
  • create a database in electronic or structured manual form by systematically and/or regularly downloading, caching, printing and storing all or any of the iPolitics Content (by spidering or otherwise);
  • frame, harvest or scrape the iPolitics Content or otherwise access the iPolitics Content for similar purposes.

Linking A site or service may establish a link to iPolitics.ca provided that it has written permission from iPolitics to do so, these iPolitics Policies are adhered to and the link does not imply sponsorship or endorsement of a web site, product or service or misrepresent its relationship with iPolitics or present false information about iPolitics. You may not use logos, trademarks or copyrighted materials without the express written consent of the owner of the mark or right. Unless you are creating Summaries as described above, you may not frame or otherwise incorporate iPolitics Content without prior written consent. iPolitics reserves the right to request any link be disabled.

4. User Generated Content

iPolitics.ca includes discussions and blogs that allow users and iPolitics’ journalists to interact.

To the Posters of User Generated Content: You are responsible for all the content of any of your User Generated Content that you or we publish. You must comply with any specific rules posted on blogs or forums and iPolitics will own the copyright in any of your User Generated Content. iPolitics has the right but not the obligation to publish, re-use, archive, modify, delete or commercially exploit that User Generated Content in whole or in part as we see fit at any time, whether on iPolitics.ca or otherwise, without any requirement to pay you for this and with or without attribution to you. You specifically waive any moral rights that you may have in regard to the User Generated Content. You are financially responsible to us for any claim against us by any third party that relates to your User Generated Content. You agree that you will not post, link or publish any;

  • threatening, abusive, libelous, indecent or otherwise unlawful material;
  • material that infringes the copyright or other rights of any third party;
  • advertising or promotion or other form of unsolicited communication;
  • recommendations for investment;
  • software viruses, files or code designed to interrupt, destroy or limit the functionality of iPolitics.ca or any computer software or equipment;
  • other users’ personal information;
  • material that misrepresents the identity of or any connection with any person or entity; or
  • material unrelated to the Forum or the Forum’s topic.

To the Readers of User Generated Content: The Forums contain User Generated Content submitted by users over whom iPolitics has no control so we cannot assess, police or guarantee the content of any User Generated Content. Some users may post misleading, untrue or offensive information. Where we have received written notice of any User Generated Content that is misleading, untrue, offensive, unlawful, infringes third party rights or is potentially in breach of these terms and conditions, then we will review that User Generated Content. If you have concerns about a specific piece of User Generated Content, please notify us immediately with specific details by contacting us at forums@ipolitics.ca.

5. Use of Third Party Links and Services is at your Discretion

Hyperlinks may take you out of iPolitics.ca and connect you to other web sites or services provided by third parties, including our advertisers and sponsors (“Third Party Sites”). iPolitics provides these hyperlinks to you as a convenience and the inclusion of any hyperlink does not imply endorsement by iPolitics of the site. These sites are not under the control of iPolitics and by accessing them, you do so at your own risk.

Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on iPolitics.ca complies with all applicable laws and iPolitics is not responsible for any error or inaccuracy in advertising or sponsorship material. It is your decision whether you purchase or use any third party products or services made available on or via Third Party Sites. Our Privacy Policy does not apply to Third Party Sites.

Advertisers and sponsors are bound by the terms of the On-line Advertising Contract, Terms and Conditions.

6. Copyright and Intellectual Property

All materials contained on this web site, including graphics, text elements, site design, logos, images and icons, as well as the selection, assembly and arrangement thereof, is the sole property of iPolitics (unless expressly stated otherwise), and are protected by applicable copyright, trademark and other intellectual property laws, and may not be reproduced, distributed, transmitted, displayed or published without the prior written permission of iPolitics, except under specific limited circumstances as described in this iPolitics Terms of Use and Related Policies. All rights, title and interest in the material are reserved.

iPolitics & Design and iPolitics are trade-marks and the property of iPolitics Inc. All other trade-marks, product names, company names and logos cited on this web site are the property of their respective owners. Users are prohibited from using any trade-marks, product names, company names and logos without the written permission of iPolitics or such third party which may own the trade-marks, product names, company names or logos.

7. iPolitics Responsibilities

We accept no financial responsibility to you arising from your use of Green Chamber Guide, iPolitics.ca or the iPolitics Content and if you are a subscriber to Green Chamber Guide or iPolitics.ca we strictly limit any responsibility to you to the price you paid for your subscription. In no circumstances do we accept responsibility for your use of Third Party Sites or their related products of services.

The iPolitics Content is only for your general use and entertainment; it is not intended to address any particular requirement and does not constitute any form of advice, recommendation, representation or endorsement by iPolitics. It should not be relied for any purpose and is not a substitute for appropriate independent advice. iPolitics Content may not be current and share price information may be delayed, rounded up/down or obsolete and may not be entirely accurate. Any third party whether named on or linked to from iPolitics.ca is your own responsibility and dealt with at your own risk.

  • IF YOU INCUR ANY LOSS AS A RESULT OF USING GREEN CHAMBER GUIDE, IPOLITICS.CA OR ANY IPOLITICS CONTENT OUTSIDE THE SCOPE OF THESE TERMS AND CONDITIONS, IPOLITICS ACCEPTS NO RESPONSIBILITY (LIABILITY) TO YOU FOR THIS.
  • IF YOU HAVE PAID FOR A SUBSCRIPTION, THEN IPOLITICS ACCEPTS RESPONSIBILITY (LIABILITY) TO YOU FOR ANY DIRECT DAMAGES YOU ACTUALLY INCUR ARISING OUT OF YOUR USE OF GREEN CHAMBER GUIDE, IPOLITICS.CA OR THE IPOLITICS CONTENT IN ACCORDANCE WITH THESE TERMS AND CONDITIONS, SUBJECT TO A LIMIT EQUAL TO THE PRICE PAID BY YOU TO IPOLITICS FOR YOUR SUBSCRIPTION DURING THE YEAR IN WHICH YOU INCUR THE DAMAGE. YOU MAY AT YOUR OPTION RECEIVE A RENEWAL TO YOUR SUBSCRIPTION FREE-OF-CHARGE AT THE POINT OF RENEWAL FREE-OF-CHARGE, IN PLACE OF MONETARY DAMAGES.
  • IF YOU HAVE NOT PAID FOR A SUBSCRIPTION, THEN IPOLITICS ACCEPTS NO RESPONSIBILITY (LIABILITY) TO YOU FOR ANY LOSS OR DAMAGE YOU MAY INCUR AS A RESULT OF YOUR USE OF GREEN CHAMBER GUIDE, IPOLITICS.CA OR THE IPOLITICS CONTENT IN ACCORDANCE WITH THESE TERMS AND CONDITIONS.

THE LIMITATIONS OF LIABILITY IN THIS SECTION 7 APPLY FOR THE BENEFIT OF IPOLITICS, ITS AFFILIATES AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS AND ASSIGNS.

TO THE FULL EXTENT PERMITTED BY LAW YOU ACKNOWLEDGE AND AGREE THAT OUR THIRD PARTY CONTENT AND DATA SUPPLIERS HAVE NO LIABILITY WHATSOEVER TO YOU IN RESPECT OF ANY OF THEIR DATA SUPPLIED TO YOU AS PART OF THE IPOLITICS CONTENT. YOU ALSO AGREE TO WAIVE, TO THE FULL EXTENT PERMITTED BY LAW, ANY RIGHT YOU MAY HAVE TO BRING LEGAL CLAIM AGAINST SUCH THIRD PARTIES ARISING FROM YOUR USE OF THEIR CONTENT OR DATA ON ANY IPOLITICS SERVICE.

8. Subscription Services and Trial Access

Pricing and Payments: Details on subscription and trial access rates can be found in the Subscription page box on our home page and may vary from time to time. No more than one free trial per subscriber is allowed in any twelve month period. iPolitics does not guarantee that your subscription or temporary access will be activated by any specified time. Your subscription will only be accepted by us and a contract formed when we have successfully verified your payment details and email address, at which point we will provide you with access to your subscription. iPolitics reserves the right to delay or reject any registration in its discretion, for any or no reason. You must provide us with complete and accurate payment information and, in so doing, represent that you are entitled to purchase a subscription using those payment details. If we do not receive payment authorization or any authorization is subsequently cancelled, we may immediately terminate or suspend your subscription and may contact the issuing bank/payment provider and/or law enforcement authorities/other appropriate third parties. If you are entitled to a refund under these terms and conditions we will credit that refund to the card or other payment method you used to submit payment, unless it has expired in which case you must contact us for a refund. You agree to pay the fees at the rates notified to you at the time you register. If we incorrectly state a price to you, we are not obliged to provide you with a subscription at that price and reserve the right to notify you of any pricing error. In this case, we will refund you any money you have paid us in full.

Renewals: Your subscription will automatically renew at the end of its term unless you give us 30 days notice of termination. If you chose to pay monthly, your subscription will continue until you give us 30 days notice that you no longer wish to subscribe, in which case you will stop paying the monthly fees at the end of the month in which the 30 days notice expires. Please see the “Cancellations by Subscriber” section below. We will charge the subscription using the same card or other payment method that you previously used. We reserve the right not to notify you in advance of any changes to the price in your subscription that will apply upon renewal.

Cancellations by Subscriber: You may cancel your subscription with 30 days written notice and we will refund to you the cost of the remainder of your subscription after the 30 days notice has expired using the same payment method you used to subscribe. You may notify us of your wish to cancel your subscription by contacting our Customer Services team at customerservice@iPolitics.ca.

Cancellations by iPolitics: iPolitics reserves the right to suspend or terminate your subscription if you breach these terms and conditions, with or without notice and without further obligation to you. You will not be entitled to any refund in these circumstances. If however we terminate or suspend your subscription for any other reason and/or permanently cease publishing Green Chamber Guide, iPolitics.ca, the iPolitics Content or cease to provide subscription services then, unless there are exceptional circumstances, we will provide you with a pro rata refund to your credit card any remaining and unexpired period of your subscription.

9. Privacy Policy

iPolitics Inc. acknowledges the importance of protecting the privacy of iPolitics.ca users. The information we collect is used to improve the services we offer, to improve our web site’s content, and to communicate with you, including, contacting you regarding your subscription or with updates to our web site or other marketing information. iPolitics approaches our communications on Green Chamber Guide and iPolitics.ca with respect for, and commitment to protecting, the privacy rights, concern, and respect for the different sensibilities of our users.

This Privacy Policy sets out how iPolitics’ collects, uses and safeguards users personal information. Our site contains links to third party sites which are not subject to this Privacy Policy. We recommend you read the privacy policy of any such sites you visit.

Information Collected: When you access our site and have not registered or subscribed to our services you access anonymously. Personal information such as your name, address, phone number or e-mail address is not collected as you access. If you register with us or purchase our online service, access our website from an e-mail or other personalized communication sent to you or provide us with personal information, you will allow us to identify you.

For both anonymous visitors and known visitors to our web site, we collect information such as the server your computer is logged onto, the domain name of your internet service provider, your browser type and version and your IP address. An IP address is a number that is assigned to your computer automatically and required for using the Internet. We may also derive the general geographic area associated with an IP address. We use “cookies”, sometimes in combination with “web beacons” or similar technology to collect information about how this website is used such as average time spent on this website, pages viewed, and information searched for, access times, response rates to online or e-mail advertising and other relevant information about your online experience. If you are an anonymous visitor, the information in this paragraph does not personally identify you.

Consent: We will seek your prior consent to the collection, use and disclosure of the information as required by applicable privacy legislation. You may also withdraw your consent to any further collection, use or disclosure of information about you at any time by giving us reasonable notice.

Information we Collect when you Register, Subscribe or Otherwise Identify Yourself: The types of information we may collect include your name, email and mailing address, employment information, payment details such as credit card and billing information and any other information about your subscription and usage. Publicly available information, such as a public directory listing of your name, address, telephone number and electronic address, is not considered personal information.

Information Use and Transfer: When you register, subscribe or otherwise identify yourself online, this also allows us to personalize our communications and offers to you and allows us to provide you with a more effective user experience by recognizing when you are on this website. The information also helps us identify the type of web site content our users value most. We then use this information to improve the services we offer and to improve the web site. About Cookies and Related Technology: A cookie is a small piece of information that a website transfers to the hard drive of a visitor’s computer for record-keeping purposes. A web beacon, also known as a “clear GIF” (a common format for image files), is an invisible file located on web pages that you visit. They are often used in combination with a cookie to track navigation of a website. However, we cannot guarantee that it is completely secure from people who might attempt to evade our security measures or intercept transmissions over the Internet. iPolitics does not house user payment information such as credit card information. Personal information may be stored in the United States and as such, may be subject to the United States “Patriot Act”.

Access: At your request, except in limited circumstances, as specifically provided by applicable privacy legislation, iPolitics can tell you whether they hold personal information about you. They can tell you the source of the information, allow you access to your personal information and find an account of the use that has been made or is being made of the information and the third parties to which it has been disclosed. iPolitics will only refuse access to information about you in those circumstances permitted or required by applicable privacy legislation. If iPolitics refuses access to you, it will provide you with the reasons for its refusal upon request. Exceptions may include information that contains references to other individuals, information that cannot be disclosed for legal, security or commercial proprietary reasons, and information that is subject to solicitor-client or litigation privilege. iPolitics will respond to your requests for access in accordance with applicable privacy legislation.

10. Governing Law and Jurisdiction

This web site is controlled by iPolitics in Ottawa, Ontario, Canada. By accessing this site, you agree that any legal matter that may arise between you and iPolitics relating to the contents of this web site shall be governed by the laws of the Province of Ontario and exclusively by its courts without reference to any other jurisdictions’ laws including choice of law legislation.

11. General

You may not license or transfer any of your rights under these terms and conditions. We may transfer any of our rights or obligations under these terms and conditions to any company within the iPolitics group of companies but if we do so we will ensure that any company to whom we transfer our rights or obligations will continue to honour your rights under them.

If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which will remain in full force and effect.

12. Changes to iPolitics Terms of Use and Related Policies

iPolitics reserves the right, in its sole discretion, to modify, alter or otherwise update the iPolitics Policies at any time. If you are an iPolitics.ca subscriber, any changes will become effective from the date of your next payment following the change unless we notify you otherwise. If you are not an iPolitics.ca subscriber, by accessing this website after notice of such change is posted, you agree to be bound by the modifications, alterations or updates.
